What we do: briefly, we provide 100% principal, independent, no-conflict, bespoke, customized expert evaluations and consulting and expert (declarations, depositions, testimony, rebuttal testimony, reports, rebuttal reports and opinions, opposing damages model, model flaw(s) and or assumption(s) reviews), document review, discovery document production request list assistance, deposition script preparation assistance, claims preparation assistance services on a wide range of standard of care, custom and practice “liability” exposures and potential damages and valuation in the fiduciary, securities, banking, compensation, employment and governance arenas involving or potentially involving any and all types of parties, balance sheets and legal entities). This is an exceptionally broad yet exacting and often overlapping, time-sensitive area of expertise.
We are unique in that we perform both liability exposure risks and potential damages therefrom. No two projects or cases are the exactly the same. To be clear, we do not provide a commodity-like service.
Subject to availability, Mr McConnell may provide brief (strictly limited to less than 10 minutes) initial courtesy consultations. Please call or email the office to request a consultation. Until retained, there is no privilege; do not send any documents or email attachments until we are retained and we request them. We do not review any documents, messages or materials prior to being retained. *Consultations over the initial courtesy time are subject to a fee of $295.00
In our eighteenth year of providing independent expert consulting we sense the need to convey some rules of the house: We are typically rapidly responsive, we’ve found in our 35 years plus of professional experience, litigation matters can often be exceedingly urgent and time-sensitive whether you realize it or not. Example: we were contacted by a practitioner who stated he had thirty years of legal experience (as if that somehow covered all the bases, however NOT in the area of his case, and NOT in the area of an obvious claim he was oblivious to which required urgent attention and filing).
NEW office procedure for 2023: All inquiries will receive a reply email or text requesting your practitioner’s SBN, your full name, the case caption party/ies, opposing counsel, venue and hearing officer(s) and calendar conflict check, the nature of the matter and sesrvices you are seeking. We have received numerous time-wasting scam inquiries over the past several years necessitating this new office procedure. Afterwards, all potential engagements require discussion, please call, email or text the office to make arrangements. All engagements require written approval and fees due in advance. There are NO fee or arrangement quotes absent the above, no exceptions, please do not ask. All fee quotes are only provided in a written potential engagement retainer agreement, requiring a payment of $295.00 office processing fee due in advance. This fee is creditable to the initial retainer if any, and is NON-refundable. You agree it is earned in full upon receipt.
All requests for designations, disclosures and or availability require approval and payment in advance. Designations lacking explicit written approval by Mr McConnell, in advance (including unauthorized disclosures) are strictly prohibited and may be violations of applicable statutes and or rules of professional conduct. All deposition attendance fees are due in advance, there are no exceptions.
Unauthorized use of any of Mr McConnell’s copyright – protected pages, posts or descriptions of services are prohibited are not cool. If you would like to use any of the material, just call the office or send an email or text us.
Effective January 1, 2020 priority or non-priority engagements are billed on a monthly or part thereof minimum fee arrangement. Please contact the office to discuss a potential project or engagement. All inquiries are held in strict confidence. However, until retained there is no privilege implied.
Previously, effective January 1, 2019, after ten years of no fee increases fees were increased on all new projects and engagements.
An office administrative fee and or calendar availability hold fee are required prior to the office issuing a retainer agreement, in advance of retention, if any. These fees are creditable to our initial retainer request if any and as stated above are NON-refundable and you agree they are earned in full upon receipt. We are fully aware such fees may seem unusual that’s exactly the purpose, to help filter out dubious requests for a retainer agreement, attempts to conflict us out of a case or assistance when the practitioner and or associates may primarily be seeking to create billable time at our expense and or obtain “free” guidance and or information on a matter.
